Terms and Conditions for Online Donations

1. Purpose
These Terms and Conditions regulate access to and use of the online donation system provided by the FUNDACIÓN ALBEIRO VARGAS Y ÁNGELES CUSTODIOS, a non-profit entity legally established in accordance with the laws of the Republic of Colombia, identified with NIT 800 169 294-7, with its registered office in the city of Bucaramanga.
By making a donation through the website, the donor declares that they have read, understood, and fully accepted these terms and conditions.
2. Nature of the donation
The amounts provided by users through the donation platform constitute voluntary, free, irrevocable contributions without direct compensation in favor of the Foundation for the fulfillment of its social purpose and the development of its programs, projects, and activities.
The act of making a donation does not create an employment, commercial, corporate, contractual, or service relationship between the donor and the Foundation.
3. Donor's capacity
The donor declares that:
- They are of legal age and have full legal capacity to make the donation.
- They act on their own behalf or have the necessary authorizations to act on behalf of a legal entity.
- The donated resources come from lawful activities.
- They are not included in national or international lists related to money laundering, terrorism financing, or illicit activities.
4. Payment methods
Donations may be made through the payment methods enabled by the payment gateway contracted by the Foundation.
The Foundation does not store or directly manage the financial information of the credit, debit cards, or bank accounts used by donors, which is processed by the respective payment gateway under its own security standards.
5. Confirmation of the donation
Once the transaction is approved by the corresponding financial entity, the donor will receive an electronic confirmation of the operation at the email address provided during the donation process.
The Foundation may issue donation certificates when legally appropriate and when the donor provides the required information for that purpose.
6. Refund policy
Given the voluntary and irrevocable nature of donations, these WILL NOT be subject to refund.
However, the Foundation may evaluate reversal requests when:
- There is evidence of fraud or impersonation.
- A technical error occurred in the transaction.
- A duplicate charge was made.
- There is any legal cause that justifies the reversal.
Requests must be submitted within five (5) business days following the transaction through the Foundation's contact channels.
7. Allocation of resources
The donations received will be allocated to fulfill the institutional mission, social programs, projects, reasonable operational expenses, and other activities authorized by law and the Foundation's bylaws.
When a specific campaign indicates a particular allocation, the Foundation will seek to apply the resources to that end. In case of material or legal impossibility, it may allocate them to similar or complementary programs.
8. Prevention of money laundering and terrorism financing
The Foundation may refrain from accepting donations or request additional information when there are reasonable indications that suggest risks associated with money laundering, terrorism financing, corruption, fraud, or any illicit activity.
Likewise, it may report operations when there is a legal obligation to do so.
9. Treatment of personal data
The personal data provided by the donor will be processed in accordance with Colombian legislation on personal data protection and the Foundation's Personal Data Treatment Policy.
The information will be used to:
- Manage and record donations.
- Issue donation certificates when appropriate.
- Inform about institutional programs, projects, and activities.
- Fulfill legal and accounting obligations.
- Maintain communication with donors.
The data subject may exercise their rights to consultation, updating, correction, and deletion through the Foundation's contact channels.
10. Responsibility
The Foundation will not be responsible for:
- Failures in communication networks or internet services.
- Interruptions attributable to the payment gateway or financial entities.
- Errors attributable to the user when filling out the transaction information.
- Events of force majeure or fortuitous cases.
11. Intellectual property
All contents of the website, including texts, images, logos, designs, brands, and other elements, are the property of the Foundation or are used under the corresponding authorizations.
The total or partial reproduction will require prior and express authorization.
12. Modifications
The Foundation may modify these terms and conditions at any time. The modifications will take effect from their publication on the website.
13. Applicable legislation
These terms and conditions will be governed by the laws of the Republic of Colombia.
